All agreements are subject to the general conditions of sale, delivery and payment.

All our offers and quotations are without engagement, unless explicitly provided otherwise. Prices do not include value added taxes and other levies.

Contracts shall be binding only after the have been confirmed by us against sending an e-mail, or if they get the status 'accepted'.

Although the times of delivery agreed upon will be observed as much as possible, we cannot be held liable for exceeding them insofar as such excess can be deemed reasonable.

If we are prevented from delivery owing to force majeure, we shall be entitled to extend all or some of the conditions of delivery by the duration of the force majeure, or to cancel the unexecuted parted of the agreement.

All deliveries take place ex storage room of seller, unless provided otherwise. If buyer does not give us specific indications we choose the route and means of transport to the best of our knowledge without assuming any liability in this regard.

Packing will be charged at cost price.

Payment shall be effected through:

-          Payment in advance (by giro).

-          Letter of Credit (L/C) according our conditions.

-          When payment of the full pro forma invoice in advance, 5% discount.

We reserve the right to charge 0,75% interest per month on the invoice amount in case of overdue payment. All further expenses for collecting our claims have to pay by purchaser.

All goods shall remain our property and shall be instantly recoverable, if required, until the have been paid for in full.

We fully guarantee all goods to be true-to-type, with the exception of varieties which are subject to mutation reversal.

We cannot be held liable for the growth and flowering of the goods supplied.

All claims shall be submitted to us writing and shall be in our possession within 5 days after the goods have been taken delivery of. If claims are acknowledged to be founded we may grant a compensation which shall never exceed the amount invoiced by us for the respective delivery.

Buyers agrees with the conditions regarding not propagating and not selling the ® marked varieties in accordance with our contract system. The marked varieties may be used for cut flower purposes only.

All claims or disputes shall be submitted to the Law Court of our district, unless provided otherwise. All agreements shall be deemed to have been concluded subject to the Dutch legislation.
